Expansion of Payment Services Act

On Tuesday, April 2, MAS amended the Payment Services Act and its subsidiary legislation, the Payment Services Regulations, to broaden the scope of payment services subject to regulation by the central bank. This move aims to impose stringent user protection and financial stability-related requirements on DPT service providers, complementing the establishment of the Cosmic centralized digital platform announced the previous day.

The amended Payment Services Act encompasses three additional activities under its regulatory purview:

The expanded scope will be implemented in phases, commencing on April 4.

MAS has established transitional arrangements for entities currently engaged in activities covered under the expanded scope.

"Affected entities must notify MAS within 30 days and submit a license application within six months from April 4 if they intend to continue these activities on a temporary basis while their license applications are under review," the central bank stated.

"The license application must be accompanied by an attestation report from a qualified external auditor verifying the entity's business activities and compliance with anti-money laundering and countering the financing of terrorism requirements, submitted within nine months from April 4," MAS added. Entities failing to meet these requirements must cease the designated activities upon the amendments' effective date.

Six months from April 4, MAS will implement measures to safeguard customer assets held by DPT service providers. These measures include placing assets in a trust account for the benefit of customers, maintaining accurate books and records, and implementing effective systems and controls to ensure asset integrity and security.

The announcement follows the implementation of the Financial Services and Markets (Amendment) Act 2023 and its subsidiary legislation, which established the legal framework for information sharing on money laundering and terrorism financing among financial institutions. The Financial Services and Markets Act 2022 (FSMA) was also amended in May 2023 to provide the legislative basis for Cosmic.
