Rakoff. The SEC's recent victory against Coinbase, where it challenged the argument that digital assets can avoid securities laws, may further strengthen this skepticism, with experts suggesting Judge Torres's Ripple ruling could be reversed.

Ripple's Favorable Ruling Faces Judicial Scrutiny

Amidst the evolving legal landscape surrounding cryptocurrencies, the fate of Ripple's landmark victory against the US Securities and Exchange Commission (SEC) hangs in the balance. Senior Correspondent for Fox Business, Charles Gasparino, has raised concerns that the favorable ruling issued by Judge Analisa Torres may not withstand higher judicial review.

Gasparino's skepticism stems from the recent decision in the Coinbase vs. SEC lawsuit, where the SEC emerged victorious. The court's decision challenged the notion that digital assets could skirt securities laws, raising doubts about the viability of the arguments presented in Ripple's case.

"A reminder to the XRP community: So far, TWO Fed judges, including the one considered the 'dean' of corporate-law judiciary (Rakoff), have scoffed at arguments using Judge Torres' Ripple ruling as precedent because the ruling itself is so incoherent," Gasparino tweeted.

The Coinbase ruling emphasized that "the 'crypto' nomenclature may be of recent vintage, but the challenged transactions fall comfortably within the framework that courts have used to identify securities for nearly eighty years." This ruling dismissed the applicability of Torres's Ripple decision as a defense.

Gasparino further highlighted that Judge Katherine Polk Failla, who presided over the Coinbase case, rejected Coinbase's contention that Torres's Ripple ruling supported its motion to dismiss. Instead, Judge Failla cited the Rakoff analysis on Terraform, which also rejected the Torres analysis.

SEC Chair Gary Gensler's hardline stance on cryptocurrencies, including Ethereum (ETH), further exacerbates concerns about the potential overturning of Torres's ruling. Gasparino believes that Gensler's determination to regulate the industry could lead to a direct challenge to Torres's ruling in the appellate division.

However, the XRP community has responded with skepticism to the narrative drawn from the Coinbase ruling. Jesse Hynes, a lawyer and XRP supporter, criticized the oversimplified interpretation of the legal nuances involved.

Bill Morgan, another pro-XRP lawyer, directly challenged Gasparino's claims, requesting specific references to support the assertions of judicial skepticism.

"To assist your readers, please point out the references in any decision of these two judges in which they 'scoff' at arguments based on the decision in SEC v Ripple," Morgan stated. "You are surely not talking about two motions to dismiss given the nature of such motions compared to a summary judgment decision."

As of press time, XRP was trading at $0.61234, reflecting the uncertainty surrounding the legal battle. The outcome of Ripple's case will have significant implications for the cryptocurrency industry, potentially shaping the regulatory landscape for digital assets.
