The Department of Telecommunications (DoT) is focused on raising awareness about the misuse of telecom resources, especially in the context of rising cyber security incidents.

This includes offenses like the illegal procurement and tampering of SIM cards, SMS headers, and other telecom identifiers, which are liable for punishment under the Telecommunication Act, 2023.

According to the recent observations by the authorities, there are instances where SIM cards are procured using fake documents or acquired legally but later handed over to third parties who engage in activities like cyber fraud.

In such cases, even the original SIM owner will be held legally responsible.

There have also been instances where telecom identifiers such as Calling Line Identity (CLI), IP addresses, International Mobile Equipment Identity (IMEI) numbers, and SMS headers are being tampered with using mobile applications and other tools to facilitate fraudulent activities.

The Telecommunication Act, 2023 specifies penalties for these offenses, which can include imprisonment for a term up to three years, a fine up to ₹50 lakh, or both.

Furthermore, the investigation by DoT has revealed that in some cases, Point of Sale (PoS) entities have been found facilitating the illegal procurement of SIM cards, thereby aiding in criminal activities.

As a result, DoT has now stepped up its scrutiny of PoS entities to prevent their involvement in fraudulent transactions.

Earlier, in October last year, DoT introduced a two-tier system to block international spam calls. The first tier of the system engages telecom service providers (TSPs) in identifying and blocking spam calls.

According to data from DoT’s International Incoming Spoofed Call Prevention System, around 13.5 million international incoming calls with tampered Indian phone numbers were detected and promptly blocked.
