LVMH sued for allegedly infringing on Watch Skins Corp.'s NFT smartwatch face design patents

Watch Skins Corporation has accused LVMH of misappropriating its "pioneering NFT display technology."

A company selling smartwatch face designs through non-fungible tokens has sued luxury fashion conglomerate LVMH for patent infringement.

According to a March 10 complaint filed to a Texas federal court, Watch Skins Corporation alleged that LVMH misappropriated its “pioneering NFT display technology.”

The complaint claimed that the TAG Heuer Connected Calibre E4 smartwatch and other products from LVMH brands used NFT display technology that was based on three patents that Watch Skins owned.

LVMH is a multinational holding company that owns dozens of well-known luxury goods brands, including Louis Vuitton, Givenchy, TAG Heuer, Tiffany, Christian Dior, Hennessy and the champagne brand Moët & Chandon.

The company is no stranger to legal battles, having recently been sued by a group of plaintiffs who accused the conglomerate of price fixing on luxury handbags.

The lawsuit against LVMH comes after the company’s brands began selling NFT collections earlier this year.

In January, the fashion house unveiled a line of limited-edition sneakers designed by Ben Reilly, which were sold as NFTs on the OpenSea marketplace.

At the same time, LVMH’s champagne house Moët & Chandon announced the launch of a collection of NFTs to celebrate the 160th anniversary of the brand’s iconic Brut Impérial champagne.

The complaint claimed that the TAG Heuer smartwatch encouraged customers to infringe on the patents by providing instructions on how to use its NFT display features.

It added that the watch allows the NFT to be displayed if owned by the user’s crypto wallet and connects to a user’s crypto wallet to guarantee authenticity of works displayed.

The company requested a jury trial and compensation for lost profits and royalties due to infringement and a court order preventing LVMH from further use of the patented technology.

At the Consumer Electronics Show in 2020, Watch Skins announced the launch of the world’s first blockchain NFT watch face marketplace.

The mobile app provides consumers with the ability to purchase authentic, licensed smartwatch faces from their favorite brands.
