Did Do Kwon Play Fast and Loose with Terraform Labs?

Do Kwon's Civil Trial: Did He Pull a Fast One?

Ground Rules: Keep It Concise

Okay, so this trial for Terraform Labs' founder Do Kwon started this week in Manhattan. Judge Jed S. Rakoff has set some pretty strict rules to keep things moving, including a four-word limit on objections. If you're not prepared, he's gonna get grumpy, fast.

Jury Duty: Diversity Rules

They're going with a jury of nine, mostly minorities. After some back and forth, they settled on three men and six women. Not bad for representation.

SEC: Déjà Vu All Over Again

The SEC came out swinging, saying Terraform was a "fraud, a house of cards." Sound familiar? Yeah, they're echoing the same language they used in the FTX case.

Terraform: Failure Is Not a Crime

Terraform's lawyer, David Patton, isn't having it. He's arguing that just because Terraform failed doesn't mean it was a scam. Failure happens in business.

Timeline of a Debacle

This whole thing started in 2022 when Terraform Labs crashed. Kwon got arrested in Montenegro for fraud, but there were delays with his extradition. Then his lawyers asked the court to push back the trial from January to late March.

Trial Without the Main Man

Now, the trial's going down, but Kwon's still not there. His extradition is still up in the air, so he's not able to attend.

Ground Rules: Objectionable Precision

Judge Rakoff's "ground rules" for the trial include "4-word objections." If you're gonna object, you gotta do it quick and clean. No "Sustained" here. Just "Objection, lack of foundation."

Jury Selection: A Balanced Perspective

They've got a jury of nine, with three men and six women. Most of them are minorities, so that's a good sign. It's important to have a diverse panel to represent the different viewpoints in this case.

SEC's Opening Salvo: Fraudulent Foundations

The SEC is coming out guns blazing, calling Terraform a "fraud." They're saying that the company was built on shaky ground and that investors lost everything when it came crashing down.

Terraform's Defense: Failure Doesn't Equal Fraud

Terraform's lawyer, David Patton, is countering the SEC's allegations. He's arguing that just because Terraform failed doesn't mean it was a fraud. Failure is a part of business, and it doesn't automatically mean that someone committed fraud.
