Hollywood Makes History: Landmark Deal Protects Artists from AI's Grasp

Apr 13, 2024 at 04:03 pm

Entertainment industry workers reached a preliminary agreement with top record labels to secure higher minimum wages and safeguards against the use of artificial intelligence (AI). The deal, spanning from 2021 to 2026, mandates consent and compensation for the use of digital replicas of artists' voices, recognizing the growing concern over AI in the entertainment sector.

Hollywood Makes History: Landmark Deal Protects Artists from AI's Grasp

Hollywood Industry Secures Landmark Deal to Safeguard Artists Amidst Artificial Intelligence Advancements

In a groundbreaking move, entertainment industry workers have forged a preliminary agreement with prominent record labels like Warner Music Group and Sony Music Entertainment, addressing concerns over fair compensation and the ethical implications of artificial intelligence (AI) in music production.

The "Sound Recordings Agreement," spanning the period from 2021 to 2026, has been unanimously approved by the executive committee of the Screen Actors Guild-American Federation of Television and Radio Artists (SAG-AFTRA), representing approximately 160,000 actors and media personnel.

Central to this agreement is the recognition of the growing threat posed by generative AI, which empowers internet users to effortlessly replicate the voices of artists, often without their consent. To safeguard against this unauthorized use, the deal mandates that record labels obtain explicit consent and provide compensation before releasing songs featuring digital replicas of artists' voices.

Under the terms of the agreement, the terms "artist," "singer," and "royalty artist" are exclusively attributed to human beings. This clear definition serves as a vital protection for performers, ensuring that their contributions are recognized and appropriately remunerated.

Beyond addressing AI-related concerns, the agreement also encompasses significant enhancements in health and retirement benefits for industry workers. Additionally, the portion of streaming revenue subject to contributions has been expanded, providing performers with a more equitable share of profits.

In the upcoming weeks, SAG-AFTRA members will cast a final vote to ratify the agreement, marking a pivotal moment for the entertainment industry.

"This agreement ensures that our members are protected," emphasized Duncan Crabtree-Ireland, SAG-AFTRA's national executive director and chief negotiator. "While technology can enhance the creative process, the essence of music must always be rooted in genuine human expression and experience."

This agreement comes on the heels of SAG-AFTRA's successful negotiation of a contract agreement with major studios in 2023, following months of industry strikes. The intersection of AI and human creativity has become a dominant theme in recent discussions between SAG-AFTRA and major studios, underscoring the need for protective measures.

In January, SAG-AFTRA reached a separate agreement with Replica Studios, an AI voice technology company, regarding the use of AI voices in video games. This agreement empowers performers with the right to consent, negotiate with the AI company, and opt out of the "continued use" of their voices in new projects.

The potential of AI in the entertainment industry is undeniable, particularly in areas such as virtual filmmaking, where it offers lifelike sets and cost efficiencies. However, the burgeoning use of AI also raises ethical concerns, making the protection of industry contributors crucial.

The AI protection deal struck between SAG-AFTRA and record labels signifies a proactive step towards ensuring fair credit and compensation for artists, while embracing the transformative power of AI in a responsible and ethical manner.
