Crypto exchange Coinbase has filed an amicus brief in the bankruptcy case of crypto custodian Prime Trust. According to Paul Grewal, Coinbase's chief legal officer, the filing is an attempt to protect customer assets that are being held by the custodian during its financial restructuring.

Coinbase intervenes in Prime Trust bankruptcy

Prime Trust is a crypto custody service that offers a range of services, including helping institutional investors to securely save their cryptocurrencies. On August 14, 2023, Prime Trust filed for Chapter 11 bankruptcy protection in Delaware, and it requested the formation of a committee to oversee the liquidation of its assets.

As of February 5, Coinbase has joined the legal proceedings surrounding Prime Trust's bankruptcy by filing an amicus brief, in which it urges the court to uphold the legal protections that are in place for customer assets held by custodi剜stians.

In an X post, Paul Grewal highlighted that customer assets should not be absorbed into a custodian's bankruptcy proceedings. He argues that both Coinbase and Prime Trust's user agreements stipulate that custodian assets belong to clients, not custodians, as outlined in Article 8.
