"The GDPR is clear. Personal data must be correct. If it's not, users have the right to have it modified to reflect the truth," said Joakim Söderberg, a data privacy lawyer at NoyB.

He added: "Displaying a tiny disclaimer to Chatgpt users, stating that the chatbot can make mistakes, is not sufficient.

Chatgpt is being investigated by the Norwegian data protection authority. The complaint is focused on the U.S. branch of Openai, which is covered by the authority.

The complaint states that his office in Ireland is responsible for product decisions that affect Europeans.

However, data protection officials in Europe may be able to intervene in any case.

Earlier this year, Italy's privacy watchdog temporarily halted Chatgpt access in the country. Afterward, the watchdog penalized OpenAI with €15 million for using people's data without a valid reason.

Still, data protection officials in Europe have become more cautious about Genai as they are still figuring out how to best apply the GDPR to these popular AI tools.

In a previous complaint about Noyb Chatgpt, the Irish Data Protection Commission (DPC), which is in charge of enforcing the GDPR, said that people should not rush to ban Genai tools. This means that officials should take some time to figure out how the law works.
