Cardano Network Hosts First Legally Enforceable Smart Contract Signed in Argentina

Cardano ambassadors Mauro Andreoli and Lucas Macchia have signed the first legally enforceable smart contract in Argentina, which is also under the jurisdiction of the country's courts. The contract is a loan agreement for 10,000 Cardano (ADA) tokens.
The loan agreement is for 10,000 ADA tokens, which are currently valued at $3,388. The loan is payable in four months at a 10% interest rate.
Andreoli announced the development in an Oct. 8 X post, highlighting that this marks the first time an Argentine court can enforce full payment in ADA from a Cardano smart contract.
The contract is also accompanied by a legal document that outlines key details of the loan, including the blockchain and wallet used as well as the transaction ID. Andreoli and Macchia signed the document to underpin these details.
According to Andreoli, this “milestone” could pave the way for Argentine courts to broadly acknowledge smart contracts as a technology capable of facilitating commercial agreements. He noted that such smart contracts can be applied to the rental of houses, purchase agreements and other legal contracts.
While Argentina already has a “robust legal framework” for commercial contracts, Andreoli stated that the next step involves educating judges on the matter.
Bitcoin and other cryptocurrencies were legalized for use in commercial contracts in Argentina in December 2023, following a decree by president Javier Milei. 10 days prior to the legalization, Milei had also announced plans to introduce a bill that would make Bitcoin legal tender in the country.
The development comes ahead of a scheduled meeting between Cardano founder Charles Hoskinson and Milei at the upcoming Cardano Summit 2024 in Buenos Aires later this month.
Several court systems have integrated crypto technology into their legal proceedings. In August 2023, a United States court used an enforcement tool on a blockchain to restrict several sanctioned individuals from accessing their crypto wallets.
Meanwhile, in 2022, the High Court of England and a Florida federal court also permitted the use of NFTs to deliver lawsuits to defendants. In the former case, the court used an NFT to serve a defendant in a copyright infringement case, while in the latter, a suit was served to the wallets of alleged crypto thieves whose identities were unknown.
