Gensler's statement that the leading lights of the crypto industry in 2024 are either in jail or awaiting extradition is demonstrably false. While several high-profile fraudsters, including FTX founder Sam Bankman-Fried, were arrested in 2022, most industry leaders remain at large and actively engaged in the space.
Despite the massive growth and evolution of the crypto sector, Gensler's comments on the Howey Test, which the SEC uses to determine whether a token offering is a security, suggest a lack of engagement with new market conditions. His statement that the Howey Test, which was established by the Supreme Court in 1940, still works fine for digital assets drew criticism from people who believe the SEC should be adapting its regulatory approach to keep pace with technological innovation.
Gensler's expansive comments on crypto, which stand in contrast to his typically cautious technocratic approach, and his failure to provide any clarity for crypto builders in the U.S. led to speculation that he may be preparing to leave his post. Several people in crypto expressed hope that Gensler's tenure, which SEC Commissioner Mark Uyeda described as "a disaster for the whole [crypto] industry," will soon be coming to an end.
