Passed in 2023, Act 851 aimed to establish a framework for regulating the rapidly growing crypto-mining industry within the state. The law provided local governments with limited oversight over mining operations, prohibiting them from imposing bans or moratoriums once a facility is operational.

However, concerns have emerged regarding the law's scope and impact. Senator Joshua Bryant, who sponsored Act 851, acknowledged that some modifications may be necessary.

"The initial legislation was intended to preempt excessive local regulation, ensuring that businesses could operate freely within the confines of state law," Bryant said. "However, we recognize that certain refinements may be appropriate."

According to KARK, a local news affiliate, Arkansas lawmakers have initiated a study to assess potential changes to the law. The study will examine a range of issues, including the environmental impact of crypto-mining operations, energy consumption, and the allocation of local resources.
